Rep. Simpson Votes to Limit Judicial Activism in Federal Courts

WASHINGTON—Today, Idaho Congressman Mike Simpson supported H.R. 1526, the No Rogue Rulings Act (NORRA). This bill would limit the power of district judges to impose nationwide injunctions. This legislation is led by Congressman Darrell Issa (R-CA).

“Elected officials have the power to legislate, not judges with overreaching agendas,” said Rep. Simpson. “Legislating from the bench and judge shopping have weaponized our judicial system, and limiting the power of district judges to impose nationwide injunctions is a common-sense solution to combat this problem. The United States Constitution gives Congress the authority to regulate the jurisdiction of lower federal courts. This legislation is a critical step forward in returning district courts to their appropriate roles and restoring constitutional balance within our judicial system.”

Background on NORRA:

  • The No Rogue Rulings Act returns the district courts to their appropriate role of resolving specific disputes between parties appearing before them by limiting judges’ ability to issue an order for injunctive relief that is broader in scope than restricting the actions of a party before the court with respect to the party seeking injunctive relief.
  • Increasingly, district court judges have issued nationwide injunctions, halting the implementation of executive orders and policies far beyond the scope of the parties involved in a particular case.
  • 67% of all federal injunctions in the last century were against President Trump, with 92% of those issued by Democrat-appointed judges.

The measure passed with a vote of 219-213.
